1. Acceptance of Terms
Welcome to NeighborHub. By accessing or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and NeighborHub ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.
2. Description of Service
NeighborHub is a hyperlocal community platform that enables verified neighborhood residents and approved users to:
- Communicate via community chat and messaging
- Report and track local incidents and safety concerns
- Share and discover community events
- Buy, sell, and trade items via the marketplace
- Vote in polls and participate in community feedback
- Discover local businesses
- Access neighbourhood watch features for approved / NHW paid up members
- Receive weather and location-based information
- Receive notifications and account updates
- Share resources and neighborhood information
3. User Registration and Verification
3.1 Account Creation
- You must provide accurate, current, and complete information during registration
- You must be at least 13 years old to use this App
- You are responsible for maintaining the confidentiality of your account credentials
- You agree to immediately notify us of any unauthorized use of your account
3.2 Neighborhood Verification
- Access to community features requires verification by an administrator or approved community process
- You must be a resident of the neighborhood to be verified
- We reserve the right to request proof of residency
- Verification can be revoked if you no longer reside in the neighborhood
- Providing false information may result in immediate account termination
3.3 Account Suspension and Termination
We reserve the right to suspend or terminate your account at any time for:
- Violation of these Terms
- Providing false information
- Abusive or harassing behavior
- Illegal activity
- Spam or unauthorized commercial use
4. User Conduct and Community Guidelines
4.1 Prohibited Conduct
You agree NOT to:
- Post false, misleading, or defamatory content
- Harass, threaten, or intimidate other users
- Share personal information of others without consent
- Post spam, advertisements, or unsolicited promotions
- Upload malicious software, viruses, or harmful code
- Impersonate any person or entity
- Violate any local, state, national, or international law
- Infringe on intellectual property rights
- Use the App for any illegal or unauthorized purpose
- Post sexually explicit, violent, or offensive content
- Manipulate or misuse emergency features
4.2 Content Guidelines
- Keep content relevant to the neighborhood community
- Be respectful and constructive in communications
- Report inappropriate content to administrators
- Do not share confidential or sensitive information publicly
- Verify accuracy of safety reports and incident information
4.3 Emergency Features
- Emergency contact features are for legitimate emergencies only
- Misuse of emergency features may result in immediate termination
- Always call 911 for life-threatening emergencies
- We are not responsible for emergency response times
5. Content and Intellectual Property
5.1 Your Content
- You retain ownership of content you post ("User Content")
- By posting, you grant us a worldwide, royalty-free license to use, store, display, and distribute your User Content
- You represent that you own or have rights to all User Content you post
- You are solely responsible for your User Content
5.2 Our Rights
- The App, including its design, features, and code, is our intellectual property
- Our trademarks, logos, and brand elements are protected
- You may not copy, modify, or create derivative works of the App
- All rights not expressly granted are reserved
5.3 User-Generated Content License
By posting content, you grant us the right to:
- Display your content to other verified neighborhood members
- Store and process your content on our servers
- Moderate, remove, or edit content that violates these Terms
- Use aggregated, anonymized data for analytics and improvements
6. Privacy and Data Collection
Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:
- We collect personal information as described in our Privacy Policy
- Your location is used for neighborhood verification and local features
- Content you post is visible to verified community members
- We do not sell your personal information to third parties

7. Auto-Renewable Subscriptions (EULA)
This section constitutes the End User License Agreement (EULA) for auto-renewable subscriptions offered within the NeighborHub app. By purchasing a subscription, you agree to the following terms:
7.1 Subscription Types and Pricing
- Single User Subscription: R50 per month — provides access for one (1) verified resident.
- Household Subscription: R99 per month — provides access for the primary member and up to four (4) additional household members (maximum 5 total).
- Prices are displayed in South African Rand (ZAR) and are inclusive of applicable taxes.
7.2 Billing and Renewal
- Subscriptions are billed on a monthly recurring basis.
- Payment will be charged to your selected payment method upon purchase confirmation.
- Your subscription will automatically renew each month unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
- Renewal charges will be applied within 24 hours prior to the start of the next billing period.
- You will be charged the same price as the original subscription for each renewal, unless otherwise communicated in advance.
7.3 Cancellation
- You may cancel your auto-renewing subscription at any time by contacting your committee administrator.
- Cancellation will take effect at the end of the current billing period.
- No refunds will be provided for partial billing periods.
- Access to subscription features will continue until the end of the current paid period.
7.4 Changes to Subscription Terms
- We reserve the right to modify subscription pricing and terms with reasonable advance notice.
- Price changes will take effect at the next renewal period following such notice.
- Continued use after a price change constitutes acceptance of the new pricing.
7.5 Free Trial (if applicable)
- Any free trial period will be clearly stated at the time of sign-up.
- You will be charged the subscription price at the end of the free trial period unless cancelled before the trial ends.
7.6 Refund Policy
- All payments are final and non-refundable, except as required by applicable law.
- If you believe a billing error has occurred, please contact your committee administrator or email neighbourhubapp@gmail.com.
7.7 Termination of Access
- We may suspend or terminate your subscription access for violation of these Terms, non-payment, or any other reason permitted by law.
- Upon termination, you will lose access to subscription features at the end of the current billing period.
8. Payments and Billing
Eligible purchases and subscriptions are processed through PayStack. By completing a transaction, you authorize the applicable charges and agree to the payment terms shown at checkout.
- You are responsible for providing accurate payment and account information
- If subscriptions are offered, renewal, cancellation, and refund terms will be shown at checkout or in the relevant product flow
- We may suspend or cancel access for failed, reversed, or disputed payments where permitted by law and these Terms
9. Location Services
- The App uses GPS location for weather, neighborhood verification, and local features
- You can disable location services in your device settings
- Some features require location access to function properly
- Location data is not shared with other users
10. Marketplace Terms
10.1 Buyer and Seller Responsibilities
- Buyers and sellers transact at their own risk
- We do not guarantee the quality, safety, or legality of items listed
- All transactions occur directly between users
- We are not party to any transactions
10.2 Prohibited Items
You may not list:
- Illegal items or services
- Weapons, firearms, or explosives
- Drugs or controlled substances
- Stolen goods
- Items that violate intellectual property rights
- Live animals (without proper permits)
- Adult or sexually explicit items
10.3 Liability
- We are not responsible for disputes between buyers and sellers
- We do not provide payment processing or escrow services
- Users should meet in safe, public locations for exchanges
- Report suspicious or fraudulent listings to administrators
11. Events and Community Activities
- Event organizers are responsible for their events
- We are not liable for injuries, damages, or disputes at community events
- Event information should be accurate and regularly updated
- Cancel or update events promptly if circumstances change
12. Third-Party Services
The App integrates with third-party services:
- Firebase (Google): Cloud services, authentication, database
- Apple: Push notifications and location services
- PayStack: Payment processing for eligible purchases and subscriptions
- OpenWeatherMap: Weather data, if used
Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service issues.
13. Disclaimers and Limitations of Liability
13.1 "AS IS" Disclaimer
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of accuracy, reliability, or availability
- Warranties that the App will be uninterrupted or error-free
13.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, or consequential damages
- We are not liable for lost profits, data loss, or business interruption
- Our total liability shall not exceed $100 or the amount you paid us (whichever is less)
- We are not liable for user conduct, user content, or third-party actions
13.3 Emergency Services
- The App is NOT a substitute for emergency services (911)
- We do not guarantee emergency response times
- Emergency contact information is provided as a convenience only
- Always call 911 for life-threatening emergencies
14. Indemnification
You agree to indemnify, defend, and hold harmless NeighborHub, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any law or third-party rights
- Your User Content
15. Dispute Resolution and Arbitration
15.1 Governing Law
These Terms are governed by the laws of the jurisdiction in which NeighborHub is operated, without regard to conflict of law principles.
15.2 Informal Resolution
Before filing a claim, you agree to contact us at neighbourhubapp@gmail.com to attempt informal resolution.
15.3 Arbitration Agreement
Any disputes shall be resolved through binding arbitration rather than in court, except:
- Small claims court disputes
- Intellectual property disputes
- Requests for injunctive relief
15.4 Class Action Waiver
You agree to bring claims individually and waive the right to participate in class actions or class arbitrations.
16. Modifications to Service
We reserve the right to:
- Modify or discontinue the App at any time
- Change features, pricing, or terms
- Suspend the App for maintenance or updates
We will provide reasonable notice of material changes when possible.
17. Termination
17.1 Your Right to Terminate
You may delete your account at any time in the home tab user settings. Deletion is permanent and cannot be undone.
17.2 Our Right to Terminate
We may suspend or terminate your access immediately for:
- Violation of these Terms
- Illegal activity
- Abuse or harassment
- Non-payment for paid features or subscriptions
- Any reason with or without notice
17.3 Effect of Termination
Upon termination:
- Your access to the App will cease
- Your User Content may remain visible (as "[Deleted User]")
- We may delete your personal information per our Privacy Policy
- Provisions that should survive (indemnification, liability limitations) remain in effect
18. Children's Privacy
The App is not intended for children under 13. We do not knowingly collect information from children under 13. If you believe a child has provided information, contact us immediately.
19. California Residents
Under California Civil Code Section 1789.3, California users are entitled to:
- A description of the complaint process
- Contact information for the Complaint Assistance Unit of the Division of Consumer Services

20. International Users
The App is operated from the United States. If you access from outside the US:
- You are responsible for compliance with local laws
- Your data may be transferred to and processed in the US
- By using the App, you consent to data transfer and processing in the US
21. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
22. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NeighborHub regarding the App.
23. Assignment
You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
24. No Waiver
Our failure to enforce any provision does not constitute a waiver of that provision or our right to enforce it later.

26. Acknowledgment
BY USING NEIGHBORHUB, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
